Travel, Tour & Pickup Service Terms & Conditions and Waiver of Liability

Thank you for joining EXPAT LIFE GHANA TOURS operated by Expat Life Ghana LLC. Travel services are provided to you subject to these terms and conditions. These terms and conditions bind you, all members of your travel party, and all minor dependents in your legal care.
References in these terms and conditions to Expat Life Ghana Tours include parent company Expat Life Ghana LLC, and its employees, agents, contractors, and suppliers. Expat Life Ghana or EXPAT LIFE GHANA TOURS (“EXPAT LIFE GHANA TOURS” or “Tour Operator”) is operated by Expat Life Ghana LLC. By booking or participating in a tour or any other tour product, you (“you” or “Client”) agree to these terms and conditions (“Terms”). If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of other participants in your party.
READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS. You (the party agreeing to these terms by reserving, purchasing, and/or participating in the tour) hereby waive any and all claims you may have now and in the future, release from all liability, and agree not to sue Expat Life Ghana LLC, its officers, agents, representatives, employees, or tour guides for any personal injury, death, property damage, or loss sustained by you as a result of your participation in the travel, tours, and services provided.
1. Assumption of Risk
Traveling is inherently risky and requires an understanding that modes of transport, accommodations, and itineraries may change, even after the tour has commenced, without prior notice due to circumstances beyond the Tour Operator’s control. The Tour Operator reserves the right to amend, vary, reroute, or cancel Tours and cannot guarantee exact arrival or departure times. You acknowledge that participation is voluntary and that changes to the Tour may incur additional charges at the cost of the client.
The Tour Operator will not be held liable for cancellations, re-scheduling, or re-routing due to pandemics, forces of nature, terrorism, civil unrest, war, accidents, or other forces beyond our control. You assume the risk associated with possible lower standards of hygiene, accommodation, and transportation found outside of North America. You also assume risks associated with modes of travel, illness, disease, physical exertion, and alcohol consumption, knowing that access to evacuation or suitable medical supplies may not be immediately available. By booking a tour, you agree to take full responsibility for your own actions, safety, and welfare.
2. Third-Party Operators
EXPAT LIFE GHANA TOURS acts solely as an agent between participants and third-party suppliers, their local operators, and sub-contractors, and thus cannot accept any responsibility for their services. Any services provided by third-party suppliers are subject to their specific terms and conditions.
Tour prices do not include airfare unless expressly mentioned. Flight cancellation and delays are beyond the control of the Tour Operator and must be settled through the respective airline and/or your travel insurance.
3. Participant Responsibilities
You understand that you will be a member of a group and will conduct yourself in a way that will not endanger the group or yourself. If you fraudulently represent yourself as fit for this trip, or if the Tour Operator feels your behavior may cause danger, distress, or material annoyance to other clients, the Tour Operator may terminate your Tour at your own expense without compensation for missed portions.
Tour participants must prepare by studying the itinerary, obtaining personal identification documents, visas, vaccinations, appropriate clothing, and equipment. Optional activities, meals not listed as included, drinks, and personal expenses are undertaken at your own expense.
4. Medical Issues
If you suffer from any known medical conditions, you must let us know in advance. You are responsible for assessing the risks and requirements for the Tour. The Tour Operator will make every effort to accommodate dietary requests but cannot guarantee fulfillment and is not liable for failures to do so.
Please carry sufficient supplies of any medications you may require. Please consult with your healthcare advisor to confirm your fitness for travel, including vaccination advice and malaria precautions. The Tour Operator does not provide medical advice. In the event of illness or injury, you authorize the Tour Operator to take necessary action for the provision of medical services at your cost. You are not entitled to any refund for missed tour portions due to sickness or injury.
5. Travel Insurance
Participants should have adequate travel insurance covering applicable travel dates. This insurance should cover death, personal accident, injury, medical expenses, air ambulance, air rescue, loss of effects, repatriation costs, and all other expenses. It is highly recommended that all passengers take out trip cancellation insurance, including flight cancellation and delay, to cover any possible losses incurred by chance. The cost of insurance is not included in the Tour price.
6. Information & Travel Documentation
As a condition of booking, you are responsible for providing requested information accurately and in a timely manner (passport information, health information, flight details, test results, etc.). The Tour Operator will not be held liable for fees, costs, or losses associated with inaccurate or incomplete information.
It is your responsibility to obtain all required documentation for entry and exit, including visas. You agree that any loss or expense incurred by the Tour Operator as a result of your failure to have proper documentation is your responsibility.
7. Liability & Force Majeure
You release and discharge the Tour Operator, its affiliates, partners, directors, representatives, and agents from any and all liability arising from your participation in the Tour. EXPAT LIFE GHANA TOURS may suspend its obligations if its ability to perform is affected by circumstances outside its control (natural disasters, pandemics, government directives, political events, war, terrorism, etc.).
The Tour Operator is not liable for death, injury, illness, delay, loss, or damage caused by an act of God, war, terrorist activity, political action, mechanical breakdown, strike, transportation cancellation, natural disaster, pandemic, fire, extreme weather, or any other cause beyond the Tour Operator’s control (“Force Majeure”).
8. Global Health Events & Pandemics
You acknowledge the risk of worldwide pandemics or periodic outbreaks of other diseases that could affect travel plans. Due to reasons not foreseeable by the Tour Operator, travel plans may be interrupted, delayed, or cancelled. You acknowledge that third-party suppliers may refuse or be unable to comply with their own refund policies, and this is out of the control of the Tour Operator. You agree to comply with all local health and safety requirements, including mandatory face coverings, temperature checks, or testing. You agree to release the Tour Operator from any liability for damages or losses that arise from cancellation or interruption due to global health events.
9. Publicity
You give permission for EXPAT LIFE GHANA TOURS and Expat Life Ghana LLC to use images (still and video) and audio of you taken during the trip for a worldwide, royalty-free license for promotional, educational, and/or commercial purposes without recourse or compensation to you.
10. Prices, Payment & Cancellation Policy
Individual space for each person is allocated and reserved by payment of an initial deposit. Deposits are non-refundable unless prior arrangements have been agreed to in writing. Failure to complete total balance payments may result in removal from the trip and forfeiture of all funds paid to date.
You may cancel your Tour by notifying the Tour Operator in writing. Cancellation fees will be determined by the date on which notice of cancellation is received:
- 120 – 90 days prior to departure: 75% of Tour Cost is refundable, less the non-refundable deposit.
- 90 – 60 days prior to departure: 50% of Tour Cost is refundable, less the non-refundable deposit.
- 60 – 30 days prior to departure: 25% of Tour Cost is refundable, less the non-refundable deposit.
- Less than 30 days prior to departure: 0% of Tour Cost is refundable.
If a Tour is cancelled by the Tour Operator before departure for reasons other than Force Majeure, and not due to the client’s negligence, you will receive a voucher for the full payments made to be used on a future Tour. The Tour Operator will not be held responsible for incidental expenses incurred due to cancelled Tours (e.g., visa fees, airfare). You acknowledge that you will not receive refunds or credits for missed or unused services or accommodation changes.
11. Amendments
The Tour Operator reserves the right to amend these Terms at any time and will post the amended Terms at www.ExpatLifeGhana.com/terms-and-conditions. Any changes will be in effect 10 days after the post date. You are deemed to have accepted any amendments to the Terms 10 days after their publish date.
By purchasing the tour, you confirm that you have read the Terms and Conditions of this tour and Waiver and Release, affirm that you fully understand them, and agree that this Waiver and Release will be legally binding upon yourself, your heirs, next of kin, executors, administrators, and successors.
